There should be a line in the contract somewhere stating something like this. "The contractor shall retain and properly dispose all of items removed, unless otherwise stated by the owner. If stated by the owner items shall be removed by the contractor and become property of the owner." Hope this helps.
Thanks for the help. I'm trying to find it in the contract but I do not believe that language is included.

I have a demolition contract for a group of structures. At the near completion of the project, the owner (city) is trying to deny salvage rights. They are trying to make me take items that I've salvaged to the landfill.
The contract does not express or deny contractor salvage rights. Salvage rights are not assigned or even mention in the contract. The contract is long but vague. The previous 2 contracts for simliar scope of work with the same governement had a one sentence statement that "contractor will be awarded salvage rights."
If the contractor has the contract to demolish the structures is contractor salvage implied if not assigned specifically in the contract? Can it be denied?
Any input would be greatly appreciated. Thanks in advance.
