[font=Verdana]Common Pleas Judge Judith [/font][font=Verdana]L.A.[/font][font=Verdana] Friedman yesterday granted a temporary injunction that bars [/font][font=Verdana]Allegheny[/font][font=Verdana] [/font][font=Verdana]County[/font][font=Verdana] from using $1.3 million from a Health Department fund to demolish 15 asbestos-containing blast stoves at a former steel mill site in Duquesne. [/font]
[font=Verdana]The Group Against Smog and Pollution filed a lawsuit against the county, the Health Department and others after the board of health approved the expenditure from the Clean Air Fund, which is made up of fines and penalties from air polluters. [/font]
[font=Verdana]Fund rules indicate grants are for projects that improve air quality or knowledge about air pollution, and not for development, GASP said. [/font]
[font=Verdana]Judge Friedman will decide whether the county should be prevented from using the funds that way. A hearing had not been scheduled yesterday.[/font]
