Company's protest about arena site demolition deemed appropriate by state

Work on Louisville, KY downtown arena could be stalled. This comes after a local company cried foul over the way bids for demolition of two buildings at the arena site were chosen.

Demolition work by continues at Second and Main Streets, but it might not for long. The only local company to bid on the demolition claims the Arena Authority gave specific guidelines for the bidders, but that the rules suddenly changed after the contract was awarded to O'Rourke Wrecking of Cincinnati.

"I knew I was right, but I was surprised that the state was going to step out against the Arena Authority," says Daryl Brown.

Brown, of Louisville-based CRS Demolition, is talking about the Kentucky Finance and Administration Cabinet's order for the Louisville Arena Authority to rescind its contract award to O'Rourke after determining the protest of CRS Demolition has merit.

"The Arena Authority issued an addendum, specifically stating that the lower levels of the Humana building -- which is the parking garage -- are to remain intact and free from structural damage," Brown said.

CRS and other companies bid on those guidelines which made an implosion of the building impossible.

Brown said, "You've got 34 million pounds of building going on eight inches of concrete."

But Arena Authority awarded the contract to O'Rourke.

"We found out that O'Rourke was awarded the contract at double our price which really baffled us," said Brown.

The Louisville Arena Authority planned to pay O'Rourke $2.8 million for the work. After investigating, CRS and other companies found out O'Rourke actually got the bid because they planned to implode the building.

Brown said, "They totally negated the addendum of saving the lower levels of the parking garage and had offered a plan to totally demolish the whole site at a price double ours."

The state is now asking the arena authority to solicit new bids which could cost the project time and money.
